NO PURCHASE NECESSARY TO ENTER OR TO WIN. YOU HAVE NOT WON YET! SWEEPSTAKES IS ONLY OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE SIXTEEN (16) YEARS OF AGE AND OLDER AT THE TIME OF THE ENTRY.  Eligible entrants who are less than the age of majority in their state of primary residence must have a parent’s/legal guardian’s permission to participate.  CUMBERLAND FARMS IS LOCATED IN CT, FL, MA, ME, NH, NY, RI and VT.  ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS APPLY. All employees, officers, directors and agents of Cumberland Farms, 165 Flanders Road, Westborough, MA 01581 (the “Sponsor”) and COHEN-FRIEDBERG ASSOCIATES, LLC Falmouth, MA 02536 (www.cfapromo.com) (the “Administrator”) and their respective parents, affiliates, subsidiaries, dealers, franchisees and retailers, (collectively the “Sweepstakes Entities”) and each of their immediate family members (parents, siblings, children and/or spouses), regardless of where they live, or members of the same household (whether related or not) are not eligible to participate in this Sweepstakes.

 

  1. Sweepstakes Period:

The Cumberland Farms Cumby’s Swag Sweepstakes (the "Sweepstakes") will begin on or about Monday, November 13, 2023 at 12:01 a.m. Eastern Time (“ET”) and ends at 11:59 p.m. ET on Sunday, December 10, 2023 (the “Sweepstakes Period”). The clock maintained by the Sponsor in connection with the operation of the Sweepstakes will be the official timekeeper of this Sweepstakes.

 

  1. How to enter:

TEXT TO ENTER: By texting you authorize the Sponsor to communicate with you via text. There will be several reply text messages to each sent/received text.

Text the Keyword CUMBYS to 48424, and you will receive one (1) entry in to the Sweepstakes (“Entry Site”). Standard text message and data rates apply to each message sent or received may apply. Other charges may apply; check your mobile plan for rates/details. Participation may not be possible on all carriers.

You will receive a confirmation message. You will not receive future text messages regarding the Sweepstakes except for notification if you are selected as a potential winner. Please note that proof of text message submission does not constitute proof of delivery/receipt.

By entering the Sweepstakes via Text, you agree to receive ongoing marketing text messages to the number provided. Consent is not required to purchase goods or services. Up to 8 msgs/mo. Alternate Means Of Entry: To enter by mail without texting hand print in ink your name, complete mailing address, telephone number including area code and date of birth on a postcard and mail to: Cumby’s® Swag Sweepstakes entry, 8429 Lorraine Road, Suite #146, Lakewood Ranch, FL 34202. Mail-in entries must be postmarked by 12/3/23 and received no later than 12/5/23. No photocopies, facsimiles or mechanical reproductions will be accepted. Sponsor is not responsible for lost, late, mutilated, misdirected, illegible, incomplete, inaccurate, stolen, or postage due entries or mail.

 

LIMIT: No matter which form of entry you select, one (1) entry per person or telephone number during the Sweepstakes Period regardless of the method of entry

 

  1. Drawing date: A random drawing will be conducted on or about Wednesday, December 6, 2023 to select ten (10) potential prize winners from all eligible entries received in accordance with the deadlines set forth herein. The random drawings will be conducted by the Administrator whose decisions are final and legally binding on all aspects of this Sweepstakes. The potential prize winners may be notified by telephone and/or mail and/or e-mail, using contact information associated with the potential winner’s entry or provided or collected at the time of entry. Entrants are solely responsible for ensuring that the information provided when entering is accurate. Sweepstakes Entities shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within seventy-two (72) hours of the first notification attempt, such potential winner will forfeit their Prize and an alternate winner may be selected. If any potential prize winner is found to be ineligible, or if they have not complied with these Official Rules or decline the Prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected.

 

  1. Prize Details: Only the number of Prizes listed below will be awarded in this Sweepstakes.

 

Ten (10) Prizes (each a “Prize”) are available..

Each Prize consists of one (1) pair of Cumby’s Apparel Co. Sweatpants and a Cumby’s Apparel Co. Sweatshirt. Approximate retail value of each Prize $99.

 

Limit: One (1) Prize per person and household.

 

  1. Misc. Prize Notes: Odds of winning depend on the total number of eligible entries received. The Winners will receive their prize by mail within approximately three (3) weeks of the winner confirmation.

 

  1. General Prize Conditions: No cash alternative or Prize substitutions will be allowed, except Sponsor reserves the right to substitute Prize(s) of comparable value if a Prize listed is unavailable for any reason. Prize winners shall be solely responsible for all federal, state and/or local taxes (if any), and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize.

 

  1. Publicity: Except where prohibited by law, acceptance of a Prize constitutes prize winner’s permission for Sponsor and its designees to use winner’s name, picture/portrait, likeness and/or voice, for advertising and promotional purposes without consideration or further permission in any media now known or hereafter devised for advertising and publicity purposes throughout the world, in perpetuity, without additional compensation.

 

  1. General Conditions:

(a)  By entering this Sweepstakes, all Entrants release the Sweepstakes Entities, Cumby’s Apparel Co., and their respective parent, subsidiary and affiliated entities including, all of their respective shareholders, officers, directors, employees, agents, contractors, attorneys, successors and assigns (the “Released Parties”) from and against all claims and damages arising out of or in connection with each Entrant's participation and/or entry in the Sweepstakes and/or his/her receipt or use or misuse  of the Prize awarded in the Sweepstakes.        

  • Released Parties are not responsible for problems downloading or uploading any Sweepstakes-related information to or from the web site or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic mail entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the web site, or any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Entrant’s ability to participate in the Sweepstakes.
  • None of the Released Parties shall be held responsible for, and Entrant hereby releases the Released Parties from any claims arising from or in any way relating to: (i) late, lost, delayed, illegible, damaged, corrupted or incomplete entries, incorrect or inaccurate capture of, damage to, or loss of entries or entry information or technical failures of any kind, including but not limited to (x) unauthorized human intervention in any part of the entry process or the Sweepstakes; (y) use of any Prize and (z) the random drawing selection process including the outcome of the Sweepstakes.

 

  1. Release: By entering entrants agree to hold harmless and indemnify the Sweepstakes Entities, and their respective brokers, stockholders, governors, and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation in the Sweepstakes; or (ii) the receipt or use of the Prizes awarded in the Sweepstakes. Entrants agree that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any Prizes awarded, other than the administration of the Sweepstakes or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively in the Commonwealth of Massachusetts, (ii) any and all claims, judgments and awards shall be limited to actual Prize in dispute but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses of the prize in dispute, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts.

 

  1. Participant’s Personal Information: Personally identifiable information submitted by entrants as part of this Sweepstakes will be treated in accordance with Cumberland Farms Privacy Policy available at https://www.cumberlandfarms.com/privacy-notice/ and text administrator’s privacy policy Purplegator, 1055 Westlakes Dr., Suite 300, Berwyn, PA 19312 at https://purplegator.com/privacy-policy/ The personal information collected in this Sweepstakes may be shared with the Sweepstakes Entities and other related parties participating in this Sweepstakes for purposes of Sweepstakes administration only.

  2. Winners List: For a list of prize winners send a self-addressed, stamped envelope to “Cumberland Farms Cumby’s Swag Sweepstakes Winners", P.O. Box 365, E. Falmouth, MA 02556-368. Requests must be received by 12/29/23. VT residents may omit return postage.
